These Terms and Conditions govern the booking and use of healthcare services provided by Costa Health at The Clubhouse Marbella. By completing an online booking and paying a deposit, you confirm that you have read, understood, and agreed to these terms.

These terms are written in accordance with Spanish consumer law, including the Ley General para la Defensa de los Consumidores y Usuarios (Real Decreto Legislativo 1/2007) and Ley de Servicios de la Sociedad de la Informacion (LSSICE). 2. Services

Costa Health provides private healthcare services including chiropractic care, osteopathy, sports massage, manual therapy, and golf body movement assessment. All treatments are delivered by qualified and registered practitioners.

Our services are not a substitute for emergency medical care. If you are experiencing a medical emergency, contact the Spanish emergency services (112) or your nearest accident and emergency department.

Appointment durations and fees are as stated at the time of booking. Costa Health reserves the right to update its fees; any change will be communicated before a booking is confirmed.


3. Booking and Deposit

When you book an appointment online, you are required to pay a deposit at the time of booking. The deposit is:

  • Currently set at 50% of the published appointment fee (subject to change - the amount applicable will be shown clearly at checkout before payment).
  • Charged to your payment card via Stripe, our secure payment provider.
  • Deducted from the total appointment fee: you pay only the remaining balance at the clinic on the day of your appointment. The deposit is not an additional charge.

Your booking is confirmed once payment of the deposit is successful. You will receive a confirmation email containing your appointment details and a secure link to manage or cancel your booking.

If we are unable to confirm your appointment due to unexpected unavailability, your deposit will be refunded in full automatically within 5-10 business days.


4. Cancellation by the Patient

You may cancel your appointment using the secure link provided in your confirmation email (your "manage booking" link).

Cancellation within the notice period - full refund

If you cancel your appointment with at least 24 hours' notice before the scheduled start time, your deposit will be refunded in full. Refunds are processed via Stripe and typically appear in your account within 5-10 business days.

Late cancellation - deposit forfeited

If you cancel within 24 hours of your appointment, or do not attend (no-show), your deposit will not be refunded. This reflects the cost of the appointment slot that cannot be reallocated at short notice.

We understand that genuine emergencies arise. If you were unable to give adequate notice due to exceptional circumstances, please contact us at [email protected] and we will consider your situation on a case-by-case basis.


5. Cancellation by Costa Health

In the unlikely event that Costa Health needs to cancel your appointment (for example, due to practitioner illness or an emergency), we will contact you as soon as possible using the details provided at booking.

If we cancel your appointment, your deposit will be refunded in full automatically. You will also be offered the opportunity to rebook at the earliest available appointment.


6. Non-Attendance (No-Show)

If you do not attend your appointment without having cancelled in advance, your deposit will be forfeited. The full appointment fee may also be invoiced at our discretion where a practitioner's time has been reserved and cannot be recovered. Repeated no-shows may result in a requirement to pay the full appointment fee in advance for future bookings.


7. How to Cancel Your Booking

To cancel your appointment:

  1. Open the booking confirmation email you received from Costa Health.
  2. Click the "Manage Your Booking" link.
  3. On the manage booking page, click "Cancel Booking" and confirm your decision.
  4. If eligible for a refund, it will be processed automatically to your original payment card.

8. Patient Responsibilities

  • Please arrive on time for your appointment. Late arrival may result in a shortened appointment with no reduction in fee.
  • Inform your practitioner of any relevant medical history, medications, or conditions before treatment begins.
  • Follow any advice or aftercare instructions provided by your practitioner.
  • The information you provide at booking (name, contact details, appointment type) must be accurate.

9. Limitation of Liability

Costa Health's practitioners are qualified and insured professionals. Our liability to you in connection with any appointment is limited to the amount paid by you for that appointment (deposit and any balance paid).

We are not liable for indirect, consequential, or special losses arising from your use of our services or website, to the extent permitted by Spanish law.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded or limited under applicable law.


10. Data Protection

Your personal data is processed in accordance with our Privacy Policy. By booking an appointment, you acknowledge that we will process your personal data, including health-related information, for the purposes of delivering the service. Full details of how we handle your data, your rights, and our use of third-party processors are set out in the Privacy Policy.


11. Governing Law and Disputes

These Terms and Conditions are governed by and construed in accordance with Spanish law. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Malaga, Spain, unless mandatory consumer law provisions require otherwise.

In the event of a dispute, we encourage you to contact us directly in the first instance at [email protected] so that we can seek to resolve the matter quickly and informally.

If you are a consumer and we are unable to resolve a dispute, you may have the right to use an alternative dispute resolution (ADR) scheme. For online purchases, the European Commission provides an Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.


12. Changes to These Terms

We may update these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that booking. The date at the top of this page indicates the most recent revision. We encourage you to review these terms before each booking.
